Clients shall be prepared to incur additional expenses to cover the above services (<a href=\"http:\/\/bregsforum.wordpress.com\/2014\/01\/27\/winners-and-losers-building-regulations-amendment-regulation-2014-si-9-of-2014\/\">read BREGs Forum article with indicative costs<\/a>).\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\tAll duty holders (clients, designers, contractors, etc) will have their own obligations. This article focus on the <strong>Clients&#39; Responsibilities<\/strong>.\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<table border=\"0\" cellpadding=\"0\" cellspacing=\"0\" height=\"232\" width=\"678\">\n<tbody>\n<tr>\n<td style=\"background-color: rgb(238, 238, 238); border-color: rgb(255, 255, 255); height: 35px; width: 500px;\">\n\t\t\t\tThese responsibilities will only apply to you if you are undertaking the following works:\n\t\t\t<\/td>\n<\/tr>\n<tr>\n<td style=\"background-color: rgb(238, 238, 238); border-color: rgb(255, 255, 255); height: 35px; width: 500px;\">\n<ul>\n<li>\n\t\t\t\t\t\tthe design and construction of a new dwelling,\n\t\t\t\t\t<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"background-color: rgb(238, 238, 238); border-color: rgb(255, 255, 255); height: 35px; width: 500px;\">\n<ul>\n<li>\n\t\t\t\t\t\tan extension to a dwelling involving a total floor area greater than 40 square metres,\n\t\t\t\t\t<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"background-color: rgb(238, 238, 238); border-color: rgb(255, 255, 255); height: 35px; width: 500px;\">\n<ul>\n<li>\n\t\t\t\t\t\tworks to which Part III applies (works where a fire safety certificate is required).\n\t\t\t\t\t<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t<strong>Key Responsibility<\/strong>\n<\/p>\n<p>\n\tThere is an obligation under section 3(5) of the Building Control Act 1990 that buildings and building works are designed and constructed in accordance with the relevant requirements of the Building Regulations. <strong>Building Owners, Designers and Builders must adhere to this legal requirement<\/strong>. In undertaking building works, appropriate measures shall be taken so that the work is in accordance with the Building Regulations. Designers, Builders and certifiers should exercise reasonable skill, care and diligence in the exercise of their duties. <strong>They and persons assigned by them should be <a href=\"#CP\">competent <\/a>for the work they undertake<\/strong>.\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t<strong>Clients&#39; Responsibilities<\/strong>\n<\/p>\n<p>\n\tThe Client\/Building owner is ultimately responsible for ensuring that buildings and building works are carried out in accordance with the requirements of the Building Regulations.\n<\/p>\n<p>\n\tThe Clients\/Building owners should ensure:\n<\/p>\n<ul>\n<li>\n\t\tthey appoint <a href=\"#CP\">competent<\/a> Designers;\n\t<\/li>\n<li>\n\t\tthey appoint a <a href=\"#CP\">competent<\/a> <a href=\"#AC\">Assigned Certifier<\/a> from the three registered professions (ie. Registered Architects);\n\t<\/li>\n<li>\n\t\tthey appoint a <a href=\"#CP\">competent <\/a>builder.\n\t<\/li>\n<\/ul>\n<p>\n\tThe above will ensure that adequate resources and <strong><a href=\"#CP\">Competent <\/a>Persons are made available to design, construct, certify and inspect the building works<\/strong>.\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t<a href=\"http:\/\/www.environ.ie\/en\/Legislation\/DevelopmentandHousing\/BuildingStandards\/FileDownLoad,35135,en.pdf\" rel=\"\" style=\"\" target=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" alt=\"Link to New Building Control Amendment Regulations 2014\" class=\"size-full wp-image-2311 aligncenter\" height=\"455\" src=\"http:\/\/isabelbarrosarchitects.ie\/blog\/wp-content\/uploads\/2014\/01\/BCAR.jpg\" style=\"\" title=\"\" width=\"479\" srcset=\"https:\/\/isabelbarrosarchitects.ie\/blog\/wp-content\/uploads\/2014\/01\/BCAR.jpg 479w, https:\/\/isabelbarrosarchitects.ie\/blog\/wp-content\/uploads\/2014\/01\/BCAR-300x284.jpg 300w\" sizes=\"auto, (max-width: 479px) 100vw, 479px\" \/><\/a>\n<\/p>\n<p>\n\t<a id=\"AC\" name=\"AC\"><strong>Assigned Certifier<\/strong><\/a>\n<\/p>\n<p>\n\tThe Assigned Certifier is the person assigned by the Client\/Building Owner as is required under the Building Control Regulations. They undertake to inspect, and to co-ordinate the inspection activity of others during construction, and to certify the building or works on completion. The role of Assigned Certifier does not include responsibility for the supervision of any builder. They may or may not be a member of the design team.\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t<a id=\"CP\" name=\"CP\"><strong>Competent Person<\/strong><\/a>\n<\/p>\n<p>\n\tA person is deemed to be a competent person where, having regard to the task he or she is required to perform and taking account of the size and\/or complexity of the project, the person possesses sufficient training, experience and knowledge appropriate to the nature of the work to be undertaken;\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t<strong>Who can sign as the Design Certifier and\/or as the Assigned Certifier?<\/strong>\n<\/p>\n<p>\n\tThe following may be appointed and sign as the <a href=\"#AC\">Assigned Certifier<\/a>, provided they are <a href=\"#CP\">competent <\/a>in relation to the particular works involved:\n<\/p>\n<ul>\n<li>\n\t\t<a href=\"http:\/\/www.riai.ie\/register\/the_register_of_architects\" target=\"_blank\" title=\"Check the Register of Architects\">Registered Architects<\/a>,\n\t<\/li>\n<li>\n\t\tRegistered Building Surveyors, or\n\t<\/li>\n<li>\n\t\tChartered Engineers.\n\t<\/li>\n<\/ul>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t&nbsp;\n<\/p>\n<p>\n\t&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The newly amended Building Control Regulations will come into operation on 1 March 2014.
